INTERIM ORDER OF THE BOARD
(by Mr. Goodman):
On July 20,
1979 the parties to this action requested
that
a Stipulation and Proposal for Settlement be adopted by
the Board.
First,
the settlement allows the $10,000 proposed
p~naltyto be reduced by the amounts paid to citizens
in
settlement of their property damage claims.
The p~rialtyherein is designed to assure that property
damage claims are settled.
It does not aid in the enforce-
ment of the ~ct or induce compliance with regulations.
It
is not the Board’s duty to expedite the settlement of private
claims and the Board does not now intend to extend its author-
ity over this area.
The penalty herein
is a contingent one.
The Board does
not favor the imposition of contingent or suspended penalties;
they interfere with the Board’s duty to determine the penalty
amount and the conditions under which the penalty is warranted.
The Board hereby rejects
the Stipulation and Proposal for
Settlement.
The case
is remanded for further proceedings con-
sistent with this Order.
