INTERIM

ORDER

OF THE BOARD (by Fir. Goodman):

On July 31, 1979 the Hearing Officer, Richard T. Sikes,

submitted a Report of Proceedings which took place on July 24,

1979 in Romeoville, Illinois without a court reporter present.

Section 32 of the Illinois Environmental Protection Act

and the Board’s Procedural Rule 328 clearly establish that

the Board must provide a court reporter to transcribe the

entire hearing and must file a complete transcript as part of

the record for public inspection. Because there is no pro-

vision for waiver of this requirement, the Board must remand

this case to the Hearing Officer for the scheduling of another

hearing.

Receipt of the Stipulation and Proposal for Settlement

and any public comment shall be recorded in the transcript.
