filed, pursuant to Procedural Rule 333, a motion
for
modification of the Board’s final Order of June 22,
1979.
The
motion sets forth that the drainage way has been completed and
requests
that the permits for disposal at the landfill of FCC
catalyst fines, hot lime sludge, calcium sulfate sludge and fly
ash not be revoked.
The notion is denied.
The intent of the
Board was to require a new application to the Agency for permits
covering these materials.
The alternative,
an evidentiary hearing
in a continuation of the enforcement case, would not be the best
forum for Caristrom to present evidence ordinarily appropriate to
a permit application.
IT IS SO ORDERED.
