    contingent and suspended penalties with the duty of the Board
    to determine the penalty amount and the conditions
    under which
    the penalty is warranted,
    the Board rejects the Stipulation
    and Proposal for Settlement.
    This case is hereby remanded for
    further proceedings consistent with this Order.
