On June
4,
1979 the Environmental Protection Agency
(Agency) filed a Motion for Leave to Amend the Complaint.
The proposed Amended Complaint updates the time period covered
by the allegations and the level
of contaminants
in the dis-
charges.
Interlake Inc.
(Interlake)
filed
a response in oppo-
sition to the Agency’s Motion for Leave to Amend on June
13,
1979 and the Agency filed
a Motion for Leave
to Reply to Inter-
lake’s Opposition to Motion to Amend on June 18,
1979.
Interlake will not be prejudiced by the Amended Complaint
being filed fifteen days before the hearing
date.
If settle-
ment is not achieved,
discovery will continue by agreement and
a new hearing will be set

Since
Interlake will not be prejudiced by the timing of the Amended
