ORDER OF THE BOARD
(by Mr. Goodman):
On June 14,
1979,
Stanadyne filed a petition before the
Board requesting variance from Rules 204(f)(2)(B)(i) and 203(a)
of Chapter
2 until November
30, 1979,
Section 35
of the Envir-
onmental Protection Act requires that variances be consistent
with the Clean Air Act as amended in 1977
(P.L.
95—95),
and the
Clean Air Act,
42 U.S.C.
§7401 et
~
requires that no air
variances be granted beyond July 1,
1979.
The Board will allow Petitioner 45 days to amend its
Petition to include a legal memorandum about the Board’s auth-
ority to grant Petitioner a variance beyond July
1,
1979.
In
addition, Petitioner should indicate, pursuant to Procedural
Rule 401(b), whether a hearing on its Petition is requested or
waived.
The statutory 90—day decision period shall begin with
the filing of the amended petition.
Failure to submit the
required information will subject the Petition to dismissal
for inadequacy.
