ORDER OF THE BOARD (by E.Z. Kezelis):
This docket was originally opened on June 2, 1997, with the filing of a proposal for rulemaking
by the Illinois Environmental Protection Agency (Agency). The Agency’s filing proposed that the
laboratory accreditation rules currently found in 35 Ill. Adm. Code 611 be amended to cross reference
the Agency’s own laboratory accreditation rules proposed as Part 186. The Board accepted this
matter for hearing on June 19, 1997, and stayed this proceeding in order to allow the Part 186 rules to
be finalized.
On November 21, 1997, the Agency filed a status report in which it reported that finalization of
the Part 186 rules was expected in December 1997 or January 1998. The Agency reported that it
would file testimony with the Board at that time as well. A second status report was filed by the Agency
on July 23, 1998, in which it reported that testimony would be presented to the Board by the end of
September 1998. No testimony has been filed with the Board and no hearings have been held.
Based on recent conversations between the hearing officer and the Agency’s counsel, it is the
Board’s understanding that the Agency intends to submit a revised proposal in this matter, but that the
date for submittal is uncertain.
Due to the age and relative inactivity in this rulemaking, the Board, on its own motion and with
the Agency’s concurrence, dismisses this docket. Dismissal of this rulemaking does not in any way
preclude the filing of additional proposals by the Agency. Any new or amended proposal filed will
receive a new docket number.
This matter is hereby dismissed and this docket is closed.
