ORDER OF THE BOARD (by 3. D. Dumelle):

This matter comes before the Board upon a September 18, 1986

petition for variance. In that petition Chanute Air Force Base

“requests a hearing in the event that the Agency shall recommend

against the granting of this petition.” Such a waiver of hearing

is unacceptable; Chanute must either waive or request hearing

unconditionally. If hearing is waived, Chanute will have the

right to request a hearing within 7 days of receipt of the

Illinois Environmental Protection Agency’s recommendation,

pursuant to 35 Ill. Adm. Code 104.181.

Unless an amended petition is filed within 45 days of the

date of this Order curing the above—noted defect, the petition

will be subject to dismissal.
