ORDER OF THE BOARD (by J,D.
Durnelle):
The Village of Bensenville (Bensenville) filed
a petition
for variance on December 11,
1980.
That petition
is inadequate
under Rule 401 of Chapter
1:
Procedural Rules,
in the following
respects:
1.
No particular provision is cited from which variance is
sought;
2.
No allegation is made concerning
the
environmental
impact; and
3.
There is no allegation of an arbitrary or unreasonable
hardship.
4.
Hearing was waived, but no accompanying affidavit
was submitted verifying the truth of the facts alleged.
Under Rule 405 of Chapter
3:
Water Pollution,
fecal
coliform shall not exceed 400/lOOml,
Relief
is apparently
requested from this rule to allow testing
of
fecal coliform
levels without chlorination.
The Board notes that such testing
is now being done
(see Urbana and Champaign Sanitary District v.
I.E.P.A.,
PCB 79—186, January
10,
1980),
If Bensenville does not file an amended petition within
45 days of the date of this Order
to
cure the above—noted
defects, the petition will be subject to dismissal.
