ORDER OF THE BOARD (by M. McFawn):
On June 3, 1999, the Board adopted an order accepting this case for hearing. In that order, the Board noted
that of the named complainants, only one—Karen Jones—had signed the complaint as the Board’s procedural rules
require. See 35 Ill. Adm. Code 101.104(g). The Board gave the other named complainants until June 25, 1999, to
cure this deficiency.
On July 22, 1999, the Board adopted an order in which it stated that only one of the other named
complainants, Anita Rice, had filed a signed complaint, and dismissed the remaining named complainants as
parties. Subsequently, complainant Karen Jones informed the hearing officer that other signed complaints had
been filed. Upon investigation, personnel from the Clerk of the Board’s office located additional complaints
signed by Jodi and Tim Leeper, Cassandra and Cheryl Vaughn, Hobart Jones, and Peggy Eberhardt. These
complaints were not docketed at that time because they were mistaken for the required copies of the original
complaint signed and filed by Anita Rice. Section 101.103(b) of the Board’s procedural rules requires that nine
copies of all pleadings be filed in addition to the original.
The Board waives the requirements of Section 101.103 with respect to these complaints and accepts them as
filed on June 25, 1999. Complainants should note that they are subject to the procedural rules of the Board with
respect to documents filed in this case, and should consult those rules for all future filings. Copies of the Board’s
procedural rules will be provided to the parties with this order.
The Board’s order of July 22, 1999, is vacated with respect to Jodi and Tim
Leeper, Cassandra and Cheryl
Vaughn, Hobart Jones, and Peggy Eberhardt. These persons are reinstated as party complainants. The caption is
amended to reflect the addition of these parties.
