INTERIM ORDER OF THE BOARD
(by Mr. Werner):
The Stipulation and Proposal for Settlement is hereby rejected.
1.
The Board is especially disturbed by the questionable require-
ment of the stipulation that the Respondent has agreed to buy the
house of the complaining neighbor.
The Board,
as a matter of general policy,
is reluctant to be
placed in a position where it is called upon to ratify such a sale of
a residential property.
2.
Concerning the provision in the proposed stipulation that the
Respondent construct an extension to the present barrier around the
rooftop compressor unit which shall be
“of
a surface density of 1/2
lb.
per sq.
ft. or greater,” the Board would appreciate a clarification of
how this surface density was determined.
This cause is remanded to the parties for further action consistent
with this Order.
