OPINION AND ORDER OF
THE BOARD
(by Mr. Dumelle):
On October
18,
1979 the Agency asked the Board to
refrain
from taking final action in this matter until Petitioners
had supplied the Board with dispersion models consistent
with USEPA guidelines.
The Agency felt that the Board
should not reach a decision which could not be approved as
a
revision to the Illinois Implementation Plan by the Federal
government.
On October 23, 1979 Interlake,
Inc., US Steel Corporation,
and WSC Corporation
(Chicago Petitioners)
responded by
stating that the Agency was not raising any issue which had
not already been reviewed by the Board.
Chicago Petitioners
felt that USEPA would approve the Board’s decision to delete
Rule 206(d) based on the present record.
In the event that
additional modelling is necessary,
Chicago Petitioners are
already prepared
to supply it to USEPA.
The Board remains convinced that Rule 206(d)
should be
deleted.
All
of the Petitioners’
modelling results were
evaluated in the Board’s Proposed Opinion dated September
20,
1979.
The Agency has not presented any new information
to dissuade the Board.
If additional
documentation is
needed for Federal approval, the Board is confident that
Petitioners will supply it.
The Board hereby adopts its Proposed Opinion and this
Opinion as
its Opinion
in this proceeding.
ORDER
Rule 206(d)
of the Air Pollution Control
Regulations is
hereby deleted.
