ORDER OF THE BOARD

On January 27,

1982 the Illinois Department of Nuclear

Safety

(DNS) submitted a proposal to the Board for promulgation

of regulations governing radiological air emissions

from

facilities currently licensed by the United States Nuclear

Regulatory Commission.

The proposal, as submitted, proposes

these regulations as a new Part XI to Chapter

2.

However,

the Board has already accepted proposals

for a new Part XI

(R81—16) and a new Part XII

(R81—20) such that this proposal

becomes

Part XIII.

Further, since Chapter

2 will likely be

codified prior to completion of this proceeding,

the Board

has requested that the DNS submit

an amended proposal

in

codified form.

Since this amendment is expected in the near

future,

the Board has encaptioned the case consistent with the

codified format.

Further, this proposal was filed under R71—9 and R80-1

(Consolidated) but has been docketed

as R82—2.

This

is due to

the fact that the present proposal replaces the P31-9 proposal

in its entirety and R80-1

(which was docketed solely for the

prupose of determining whether the Board has jurisdiction

in

this area) has already been dismissed upon the Board*s finding

that it has jurisdiction over radiological air emissions.

Therefore, the Board hereby accepts this proposal as R82—2

and authorizes hearings to be held to consider the proposal.

R79-1 is hereby dismissed as having been replaced by the

R82-2 proposal.
