ORDER OF THE BOARD (by J.D. Dumelle):
On April 9, 1981 the Illinois Municipal League filed
a petition for variance from Rules 304(B) and (C) of Chapter
6: Public Water Supplies. The petition was filed “on behal~
of Illinois municipalities.” On April 16, 1981 the Illinois
Environmental Protection Agency (Agency) filed an objection
and request for hearing and a motion to dismiss.
The motion to dismiss is hereby grant~1. As poLnted
out in the Agency’s motion, the Municipal

“has
stated
only vague concerns.” The petition gicTes no speciEi~s a~ t:~
pollutants for which variance is sought or cor.centr~tbions
of those pollutants. There is no statement of envir:jnme.nt;d.
impact, steps which will be taken to minimize that i~npact,
costs of compliance or even a clear listing o~which cities
desire relief. The petition is much more in the nature of
a rulemaking proposal than a variance petition.
Leave is granted to the Illinois Municipal League to file
a proposal for rulemaking. Alternatively, the individual cities
can certainly file individual petitions for variance.
