    ORDER OF THE BOARD (by D. Satchell):
    In an agreed motion filed April 8, 1980 Monterey Coal Company
    and the Illinois Environmental Protection Agency indicated that
    adoption of the then pending modifications of Chapter 4: Mine
    Related Pollution would provide a basis for resolving the issues
    in this NPDES permit appeal. On April 17, 1980 the Board stayed
    the permit conditions until December 31, 1980 or until an amended
    permit was issued. The modified Chapter 4 became effective August
    7, 1980 (R76—20, R77—lO; May 15, 1980, 38 PCB 307; 4 Ill. Reg. 34,
    p. 164, August 22, 1980). Since then there has been no further
    activity. The Board will dismiss this appeal unless the parties
    show cause why it should do otherwise within twenty—one days of
    the date of this Order.
    IT IS SO ORDERED.
