    Proposed Rule . Dismissal Order.
    ORDER OF THE BOARD (by R.C. Flemal):
    Section 17.5 of the Environmental Protection Act (Act) (415 ILCS 5/17.5 (1998)) requires the Board to adopt
    regulations that are “identical in substance,” as defined at Section 7.2 of the Act, to the National Primary Drinking
    Water regulations ( NPDWRs) adopted by the United States Environmental Protection Agency (USEPA). These
    regulations implement sections 1412(b), 1414(c), 1417(a), and 1445(a) of the Safe Drinking Water Act (SDWA), 42
    U.S.C. §§ 300g-1(b), 300g-3(c), 300g-6(a) & 300j-4(a) (1998). USEPA has codified its SDWA regulations at 40 C.F.R.
    141 through 143. The Board reserved this docket for any SDWA amendments adopted by USEPA between
    January 1, 1999, and June 30, 1999.
    During that time period, USEPA did amend its SDWA regulations twice. However, no Board actions is
    required based on either of these sets of federal amendments.
    No action is necessary concerning the federal amendments of January 8, 1999 (64 Fed. Reg. 1493). In that
    action, USEPA suspended the monitoring requirements for unregulated contaminants. This is a segment of the
    federal rules that has never been incorporated into the Illinois rules, since they were not necessary elements for
    implementation of a state SDWA program.
    For different reasons, no Board action is required on the June 29, 1999 (64 Fed. Reg. 34732) federal
    amendments. On June 29, 1999, USEPA adopted corrections to its August 19, 1998 (63 Fed. Reg. 44511) consumer
    confidence rules. The Board dealt with the August 19, 1998 action together with the June 29, 1999 corrections in In
    the Matter of: SDWA Update (USEPA Amendments July 1, 1998, through December 31, 1998) (July 22, 1999), R99-12.
    For the foregoing reasons, the Board hereby dismisses this docket.
