On January
13, 1982 Petitioner filed a Motion
for Continuance
with the Board.
Pursuant to Procedural
Rule 308(f), the Board has
considered
this
Motion
to be an interlocutory appeal of
the
hearing
officer’s denial of Petitioner’s oral Motion for a Continuance
made at the January 12,
1982 pre—hearing conference.
Respondent
objected at that time to a total continuance but agreed to a
bifurcated hearing.
The hearing officer denied the continuance
for the hearing on the merit because public notice of
a January 25~
1982 hearing had already been issued.
However,
the hearing officer
granted Petitioner a second hearing date to present the economic
evidence Petitioner claimed to be developing and was therefore
unavailable for the January hearing.
Since Petitioner raises no
arcjuments
in its appeal other than inconvenience, the Board
finds
no reason sufficient to overrule the hearing officer in this
matter.
The appeal is denied.
Mr. Dumelle concurred.
