ORDER OF THE BOARD (by T.E. Johnson):
On November 7, 2002, the petitioner filed a letter addressed to Dorothy M. Gunn, Clerk
of the Illinois Pollution Control Board, and Hearing Officer Brad Halloran seeking to voluntarily
dismiss this appeal. In the letter, the petitioner asserts that because of an additional award made
by the Illinois Environmental Protection Agency (Agency), the appeal is now moot and may be
dismissed with prejudice. The letter was served by facsimile and first class mail upon opposing
counsel for the Agency. On November 18, 2002, the petitioner filed a motion to voluntarily
dismiss the case for the reasons stated in the letter. To date, the Agency has filed no response to
either the letter or the motion.
The petitioner’s motion to dismiss is granted, and the docket is closed.
