ORDER OF THE BOARD
(by J.
Anderson):
The Board has received a copy of a letter dated October
1,
1981, requesting from the Agency a variance from “biohazardous
waste regulations” for its 47 member hospitals.
The Board con-
strues this as a petition to the Board for variance from some or
all of the rules contained in Part IX of Chapter
9:
Special Waste.
This petition,
generally,
fails to contain the information
required by Procedural Rule 401; petitioner should reference this
Rule in preparing its amended petition.
The Board further remarks that the 47 hospitals have not been
named,
and that the specific facts required by Procedural Rule
401(b) have not been provided concerning each individual hospital
and its individual circumstances, efforts towards compliance,
etc.
Petitioner
is advised not to place undue reliance on the petition
filed in Mercy Hospital et al.
v.
IEPA, PCB 80—218.

June 10,
1981)
in determining compliance with the requirements of
Rule 401.
The unique circumstances under which that petition was
accepted as sufficient no longer exist.
If an amended petition curing the noted deficiencies is not
filed within 45 days of the date of this Order,
this petition will
be subject to dismissal.
