    ORDER OF THE BOARD

    On September 18,
    1981 the Illinois Environmental Protection
    Agency (Agency) received a request for a provisional variance
    from the City of Springfield
    (City) requesting variance from
    Chapter
    3 standards for TDS, oil and grease, pH,
    iron,
    and
    suspended solids.
    On September 23,
    1981 the Agency rejected
    the petition as incomplete.
    On October 19, 1981 the Agency
    received further information from the City.
    On the basis
    of
    that, on October 21,
    1981 the Agency filed a recommendation
    with the Board recommending that variance be denied for all
    requested pollutants other than suspended solids.
    Based on the Agency’s finding that compliance on a short—
    term basis with the suspended solids limitation of
    Rule 408 of
    Chapter 3:
    Water Pollution, under the circumstances set forth
    in the record, would impose an arbitrary or unreasonable hardship,
    and the lack of any indication of procedural irregularities
    in this matter,
    the Board will grant the City
    a provisional
    variance as recommended by the Agency.
    The City is hereby granted a provisional variance from Rule
    438 of Chapter
    3:
    Water Pollution as it relates to suspended
    solids,
    subject to the following conditions:
    1.
    The City’s provisional variance shall begin on the
    date that draw down from the ash lagoon begins
    and shall continue for a period of
    35 days or until
    repair work is completed, whichever occurs
    first;
    2.
    The City’s discharge shall not exceed the following
    limitations:

    3.
    When discharging the City shall take 24—hour composite
    samples which shall
    be reported to the Agency withing
    10 days after the end of the variance period;
    4.
    The City shall notify the Agency when draw down will
    begin and when repair work is completed;
    and
    5.
    The City shall study the possibility of relocating
    the gas line to a more accessible location.
    Within 15 days of the date of this Order,
    the City shall
    execute a Certification of acceptance and agreement to be
    bound by all the terms and conditions of this provisional
    variance.
    The Certification shall be forwarded to the Illinois
    Environmental Protection Agency,
    Division of Water Pollution
    Control, Variance Unit, 2200 Churchill Road, Springfield,
    Illinois 62706.
    This 15—day period shall be held in abeyance
    for any period during which this matter is being appealed.
    The
    form of the Certification shall read as follows:
