OF THE BOARD

On December 21,
1981 the
Board received
an Agency Motion
to
Strike
Variance Petition dated December 18,
1981.
The
motion
identifies deficiencies addressed
by the Board
in its December
17,
1981 Order setting this matter for hearing.
The
motion is denied
as mooted by the
directions contained in the December
Order.
On January
6,
1982
Petitioner moved for an
extension of the
45 day time period set by the
Board December 17,
1981 by which
hearing was to have been held,
(Hearing has been
scheduled for
January
28,
1981,)
Petitioner
seeks a
60
day extension and waives
the
90 day decision period
for
a
like time.
In
support of its
motion, petitioner states
that there would be
insufficient time
in which to remedy
the deficiencies earlier noted
by
the Board
if
the extension is not granted.
While the
Agency~stime for response to the motion has
not
run,
the Board hereby grants the requested extension to avoid
problems which could be
caused
by
cancellation of hearing after
public
notice of the hearing date has been given.
Hearing shall
therefore be scheduled within 50 and held
within
84 days of the
date of this Order,
Pursuant to petitioners waiver, decision in
this matter is due 150 days from December
4,
1981.
Finally, while the filing of an amended petition has
not
been required,
the
Board notes that
such
an amendment in advance
of hearing
would serve to clarify the record and allow for
development of a more
efficient and orderly hearing record.
