ORDER OF THE
BOARD (by J.D.
Dumelle):
An enforcement
action was filed against the Village
of
Roselle
(Village)
on January
21,
1980,
alleging repeated overflows
of sewage in violation
of Rule 602(b) of Chapter 3:
Water
Pollution.
On
December
4,
1980 the
Board found that the Village
had violated
that rule and ordered that it
submit a plan to the
Illinois Environmental
Protection Agency
(Agency)
to minimize
overflows.
Since
no such plan had been filed
as of June
25,
1981,
the Board ordered
the Village to file
within 30 days.
The plan
was finally filed on September 3,
1981.
On November 14,
1981 the
Agency filed its
comments on the plan
indicating that the plan is
satisfactory as
it affects Mr. Daum,
This
is based upon the lack
of backups since
September,
1979 at
Mr. Daum’s residence and the
Villag&s
allegation that bolt—down
manhole lids have been
installed to discourage vandalism.
Given that the Board
has
no information before it to
indicate the contrary,
the Board finds the plan to be acceptable,
and accomplished, and that the Village has satisfied the earlier
Board Orders in this proceeding.
The Board does, however,
note the considerable delay
in
presentation of an adequate
plan,
and points out that any necessary extensions
in the time
needed to comply
should have
been requested from the Board by
a proper motion
indicating the reason
for such extensions.
Proceedings in
this
matter are hereby closed.
