OPINION AND ORDER OF THE BOARD

On April
29,
1982 the Illinois Environmental Protection
Agency
(Agency)
filed
a recommendation that the City of Spring
Valley (City) be granted a provisional variance from Rule 404
of Chapter
3:
Water Pollution,
The Agency has concluded that
compliance on a short—term basis with the limitations of Rule
404 under the circumstances in this case would impose an
arbitrary or unreasonable hardship on the City, and in fact
cialay in granting this variance could result in an increased
probability of
an adverse environmental impact.
Therefore,
pursuant to Section 35(b)
of the Environmental Protection
Act the Board will grant this recommended provisional variance.
ORDER
The Board hereby grants a provisional variance from Rule
404 of Chapter
3 to the City of Springfield for a period of
45 days subject to the following conditions:
1.
Spring Valley shall notify the Agency when they
begin draining the lagoon, when draining has been
completed, when
bypassing begins, and when the system
has returned to operation.
Notification shall be sent
within
2 days of the date of
each
of the above events

2.
All bypass
flows shall receive primary treatment
and chlorination prior to discharging.

3.
Spring Valley shall complete repairs and return
its system to operation as expeditiously as possible.
4.
Spring Valley shall take at a minimum daily grab
samples for BOD and TSS and submit the results to the
Agency
within
7
days
after
the
end
of
each
week
of
discharging.
5.
Petitioner
shall
execute
a
certificate
of
acceptance and agreement to be bound by the conditions
of
the provisional variance
in the following form:
cERTIFICATION
I,
(We), the City of Spring Valley, having read the Order
of the
Illinois Pollution Control Board in PCB 82-56 dated
April
29,
1982, understand and accept said Order, realizing
that such acceptance renders all terms and conditions thereto
binding and enforceable.
