ORDER OF THE BOARD
(by J. Anderson):
This July 20,
1981 petition for variance from the certified
operator requirement of Rule 1201 of Chapter
3 fails to provide
much of the information outlined in Procedural Rule 401.
Little
or no information is given concerning the treatment plant,
its
current operator, or the effluent discharged (401(a)(2,4),
the
specific alternative methods for achieving compliance, including
costs of and timetable
401(a)(6,8,9),
and the specific hardship
it would suffer if variance is denied.
If an amended petition
curing these deficiencies is not filed within 45 days of the date
of this Order, this petition will be subject to dismissal.
The Board notes that petitioner has requested a hearing
(which is at its own cost pursuant to Procedural Rule 412).
Should
petitioner waive hearing in its amended petition, the
petition must be accompanied by the affidavit required by Rule
401(b).
