ORDER OF THE BOARD (by Jacob D. Dumelle):
On April 8, 1982 the Village of Algonquin filed a petition
for variance from Rule 1202 of Chapter 3: Water Pollution which
the Board construes as requesting variance from Rule 1201 which
appears to be the proper rule from which variance should be
requested for the Village to receive the desired relief. That
petition is deficient in that the Village has failed to request
or waive hearing as required by Procedural Rule 401(b). The
petition also fails to include an assessment of the environmental
impact of the variance as required by Procedural Rule 401(a)(7).
Unless the Village files an amended petition within 45 days
of the date of this Order curing the above—noted defects, this
petition will be subject to dismissal.
