    ORDER OF THE BOARD

    On Narch 18,
    1982 the Illinois Environmental Protection
    Agency
    (Agency)
    filed a motion to dismiss this variance peti-
    tion on the grounds that the variance is unnecessary because
    the core sands involved are not special waste.
    On the same
    date Aurora Metals Division, Aurora Industries,
    Inc.
    (Aurora)
    filed a response indicating no objection
    to dismissal.
    On April
    14, 1982 the Agency filed a recommendation that
    the Board either deny the variance on the same grounds, or
    grant the variance subject to conditions.
    The Board will
    consider the motion to dismiss with the case.
    IT IS SO ORDERED.
    Mrs. Anderson dissented.
