ORDER OF THE BOARD

The Board hereby proposes to codify the Procedural Rules

without substantive change as Title 35, Subtitle A, Chapter I,

Parts 101 through

109.

A draft of the proposal has been filed

with the Clerk.

The draft was prepared jointly by the Illinois

Environmental Protection Agency and the Board staff.

The Board has made several changes

in the draft before

it.

The most noteworthy is the addition of a reference to the

Board’s authority to hold certain economic impact hearings

under

Ill.

The full text will not appear with this Order; however,

it will be made available to the public on request.

The Board

will accept public comments on the proposal for 45 days from

the date of this Order.

Thereafter the Board intends to file

the codified rules, with any changes made in response to

comments,

and to publish in the Illinois Register a notice of

codification without substantive change
