CONCURRING OPINION
(by D.
Anderson and J. Anderson):
The Board has accepted stipulated penalties of $2,500
against Jack Chase as an individual.
This same person was
apparently a respondent in IEPA v. Jack Chase, et al.,
PCB 79—19,
35 PCB 49, July 12,
1979,
a case which also involved open dumping
of drums filled with hazardous waste.
We have concurred in that
we agree that the Respondents have violated the Rules and that a
penalty should be imposed.
However,
the penalty against Mr.
Chase is grossly inadequate for a second instance of such a
serious violation.
