On June 10,
1982 the Board modified its April
29,
1982
Order in this matter.
Petitioner had requested that the Board
order which required installation of monitoring wells at the
site prior to the defluorination facility being activated be
deleted.
In its June
1~
1982 motion Petitioner had represented
that the defluorination unit began operation in February 1980
after negotiations with the Agency that same month.
The
Illinois Environmental Protection AgencyVs (Agency)
response
concurred with Petitioners
motion, but it included an assurance
that March 11, 1981 grab sample taken from the cooling pond
established which materials were present in the cooling pond
prior to start—up of the defluorination unit.
This would be
improbable
if the defluorination unit had been operating since
February,
1980.
After reviewing the concurring and dissenting opinions in
this matter, Petitioner realized that the 1980 dates were in
error and informed the Board by letter on June 22,
1982 that the
defluorination unit was operating
in February 1981 rather than
1980.
The Board acknowledges the correction,
The language of
the April 29,
1982 Opinion remains unchanged except as modified
on June 10, 1982.
