    ORDER OF THE BOARD (by C.A. Manning):
    On May 14, 1999, the Board received a request filed by Ayers Oil Company
    (petitioner) for an extension of the 35-day appeal period of an Illinois Environmental
    Protection Agency (Agency) determination (see 415 ILCS 5/40 (a)(1) (1998)).
    Because no formal agreement to this request has been filed by the Agency and
    petitioner has failed to file an appeal within the 35-day period following the final decision, the
    Board on its own motion dismisses this matter and closes the docket.
    IT IS SO ORDERED.
