    ORDER OF THE BOARD

    This matter comes before the Board upon a November
    15,
    1982
    motion to withdraw filed by the People of the State of Illinois
    (the People).
    The People were allowed
    to intervene
    in this
    proceeding on August 10,
    1979 since they had determined that some
    of the matters complained of might constitute violations
    of a
    previous
    Board Order.
    Based upon these violations as well as
    apparent violations of other rules,
    the Illinois Public Nuisance
    Act and the Illinois Drainage Code,
    the People filed
    a complaint
    in the Circuit Court of the 18th Judicial
    District
    (No. 80—CH—245).
    The Board granted a motion for stay pending final action in the
    Circuit Court proceeding.
    Proceedings
    in that action have now
    been concluded,
    and the People represent that the Agreed Order
    in
    that matter resolves
    the
    issues presented in this matter as well.
    Therefore,
    the People’s motion to withdraw is hereby granted.
    The Board notes that the stay in this matter is no longer
    effective and hereby orders that within 45 days of the date of
    this Order hearing should be scheduled or appropriate motions
    should be filed by the parties.
