    This matter comes before the Board upon a June

    petition for variance filed by the Little Swan Lake Sanitary
    District
    (LSLSD).
    In that petition hearing
    is purportedly
    waived; however, that waiver is not accompanied by an affidavit
    attesting to the truth of the material facts alleged as
    required by
    35 Ill.
    Adm. Code 104.124.
    Unless an amended
    petition
    is filed within 45 days of the date of this Order
    curing that defect,
    the petition will be subject to dismissaL
    IT IS SO ORDERED.
