ORDER OF THE BOARD (by J.D. Dumelle):
On June 7, 1983 the Illinois Environmental Protection Agency
(Agency) filed a motion to dismiss Alco Gravure, Inc.’s petition
for variance for failure to conform with the requirements of 35
Ill. Adm. Code 104.121 and 104.122. The Agency’s concerns are
well founded. However, the Board will not order dismissal at
this time, but rather •hereby orders Alco Gravure to file an
amended petition within 45 days of the date of this Order curing
the defects noted in the Agency’s motion for dismissal. If such
amendment is not forthcoming, the petiton will be subject to
dismissal. The Board also notes that information regarding the
financial status of Alco Gravure would be useful in a determination
of unreasonable hardships.
