ORDER OF THE BOARD (by J.D. Dumelle):

On December 23, 1982 the Department of the Army (Department)

filed a waiver of the Board’s statutory deadline for decision in

this matter and indicated that it would file an amended petition

in response to the Illinois Environmental Protection Agency’s

recommendation. Such anended petition has not been filed and the

Department has indicated that it does not intend to pursue this

matter further.

Therefore, on its own motion, the Board hereby dismisses these

proceedings.
