    ORDER OF THE BOARD

    On May
    13,
    1983 Bob Evans Farms,
    Inc.
    filed a petition for
    variance
    from
    the requirements
    of
    35 Iii. Mm. Code 309.241,
    309.202 and 306.105:
    Water Pollution.
    In that petition Bob Evans
    alleges
    that $15,000 has been expended “for legal,
    engineering.
    architectural, municipal and other fees and costs incurred in
    meeting the many requirements
    of
    local building and zoning
    authorities.~ The petition, however,
    fails to allege whether
    the
    expenses were incurred prior or subsequent
    Lo the imposition of
    restricted status.
    Unless an amended petition curing that defect
    is
    filed
    within
    45 days of the date of this Order,
    the petition will
    be subject
    to dismissal.
