FINAL ORDER. ADOPTED RULES
ORDER OF THE BOARD (by D. Anderson):
On January 7, 1982 the Board proposed to adopt a proposal
by the Illinois Environmental Protection Agency (Agency) for
regulations to enable Illinois to be granted primacy for
underground injection control (UIC) pursuant to Section 1422
of the Safe Drinking Water Act, PL. 93-523 (SDWA). The
proposal was published for comment even though it is not
subject to Section 5 of the Administrative Procedure Act
(APA) (6 Iii. Reg. 1005,1011, January 29, 1982).
The Board has modified the proposed rules in response
to comments and at its own initiative. The Board hereby
adopts the text of amendments to Part 700 and Parts 702, 703,
704, 705 and 730 which is before it, subject to format changes
which may be requested by the State Library. Because of its
length, the full text will not appear with this Order. The
Clerk is directed to file the rules with the Secretary of
State and to prepare a notice of adopted rules for publication
in the Illinois Register.
This is a final action of the Board. Because of the
possibility of extensive changes in format at the request of
the State Library, the appeal period will commence with the
filing of the rules with the Secretary of State. If a motion
for reconsideration is filed by any participant, the appeal
period for all participants will commence with an Order on
the motion in the event s,ich Order is entered after the
rules are filed.
