ORDER OF THE BOARD

On October 15,
1982 J.L. Clark filed a petition for variance
from Rule 205(n)(1) of Chapter
2:
Air Pollution.
That petition
was filed in accordance with the Illinois Environmental Protec-
tion Agency’s
(Agency’s) form APC-167 which the Board had hoped
was no longer in use since it is considerably outdated.
As
a result,
the petition is deficient in several
respects.
First, hearing was neither waived nor requested as required
by Procedural Rule Section 104.124.
However,
since the relief
requested will require a revision of the State Implementation
Plan under the Clean Air Act; the Board will order a hearing
held on its own motion.
Second, there is no discussion of the environmental impact
(Section 104.121(g),
and other information required by Section
104.121 could be presented in greater detail, especially alterna-
tives for achieving compliance, compliance costs and a compliance
plan.
Unless an amended petition is filed within 45 days of the
date of this Order, curing the above—noted defects, this petition
will
be subject to dismissal.
