 FIRST NOTICE

PROPOSED ORDER OF THE

BOARD

 (by D. Anderson):

On March 18,

 1983 the Board proposed to adopt 35 Ill,

Adm. Code 703 and 724,

 and proposed amendments to 35 Ill,

Adm. Code 702 and 705,

 This proposal, which is the main

portion of the Phase II RCRA package, appeared at

Ill,

Reg.

 4520, April 15,

 1983.

 The comment period will expire

on May 31, 1983,

The Board now proposes to amend 35 Ill, Adm, Code 700,

704,

 720, 725 and 730.

 These amendments include federal

amendments through October 29,

 1982, and amendments required

for consistency with the Phase II proposal.

 No amendments

to Parts

 721,

722

 and 723 are necessary at this time,

The Board intends to bring the two portions of the

proposal to a single

 final order.

 Therefore it will not

be necessary to split this record into subdockets.

This proposal will be published in the

Illinois Register

and a comment period will be established even

though. this

rulemaking is not subject to Section

 5 of

the

Administrative

Procedure Act,

 The comment period will be shortened to

days

after publication in order to allow adequate

time for Board

review prior to July 26,

 1983,

 the target date for final

decision.

Because the text of the proposal is lengthy,

 it will not

be distributed with the Proposed Order or appear in the

Opinion volumes.

 The public is asked to wait until the

proposal appears in the Illinois Register.

 However, a copy

will be placed in the file and made available for inspection

and copying.
