DISSENTING OPINION (by J.D.
Dumelle):
My dissent in this case is made because of the lack of in-
formation about fecal coliform levels which will occur at the
Village of Kincaid’s public water supply intake,
some 40 miles
downstream.
No data are given on dilution to the receiving stream,
if any,
or on the die—off rate for the fecal
coliforin organisms.
If fecal coliform levels at the Village of Kincaid intake
reach
2000 counts per 100 ml because of this variance then the City
of Assumption may be causing a violation of old Rule 307(C) of Chapter
6:
Public Water Supply.
But the violation,
if any,
is not the main
concern.
The concern
is whether or not the 1,424 residents of the
Village of Kincaid will continue to have a safe drinking water
supply given possible additional bacterial and viral contamination
of their raw water supply.
The record is silent on this important matter.
The Illinois
Environmental Protection Agency Recommendation mentions nothing
of any consultation with its Division of Public Water Supplies on
this subject.
