On April 2,

1981 Rowe Foundry and Machine Co. filed a

petition for regulatory change seeking site-specific amend-

ments to Chapter 2:

Air Pollution.

The proposal is related

to a pending enforcement action

and

variance

(PCB 80-174 and

81-49).

During 1981 Petitioner repeatedly asked that hearings

not be scheduled pending resolution of

the

variance

and

enforce-

ment action.

The merit hearing was tentatively scheduled for

April 22,

1982.

This was delayed until May 10,

1982,

and

then cancelled, both at

the

proponentts request.

A hearing

has now been t3ntatively scheduled for October

8,

1982.

The

proponent indicated in

a letter to the Hearing Officer that

“a hearing at this time would be premature and would interfere

with resolution of a complex matter”.

A motion filed Septem-

ber 13, 1982 stated a similar position.

It appears that

proponent is not actually prepared to go forward with its

proposal at this time.

The petition is hereby dismissed.

The proponent may refile at such time as it is ready to proceed.
