On January 27,

1983 both of these matters,

PCB 82—153,

the Alternative Standard Petition and PCB 83-11, the Variance

Petition were stayed pending the effective date of the rules

adopted in R80-22,

Sulfur Dioxide Amendments.

R80-22 became

effective on March 28,

1983.

Therefore pursuant to Petitioner~s

March 28,

1983 motion, the stay is lifted.

Furthermore, the

pleading filed March

16,

1983 will serve as the variance

petition ordered filed by the Board~sJanuary 27th Order.

Petitioner also moves that both matters be consolidated

for administrative efficiency and convenience.

Since the

relief sought and elements

of

proof

are

different

for

each

matter,

that motion is denied.

However, both matters will be

assigned to one hearing officer, and the parties are free to

schedule the necessary hearings successively.
