On August 31,
1982 the City of Springfield
(City)
filed for
a provisional variance,
and
on September
15,
1982 the Illinois
Environmental Protection
Aaency
~tAgency)
filed
its Recommendation.
The Agency recommends that variance
be
granted from the suspended
solids limitation of
Section
304,124 for
a period of five days,
the time necessary
to construct a
bypass.
Over the past two
years when cleaning its
surge lagoon,
the City has diverted flows
from a
grit
settling
basin
directly
to Lake Springfield.
It now
proposes
to
construct
a
bypass
around
the
grit
tank
and
surge
lagoon,
to
avoid
future
direct
discharges.
The
Agency
has
concluded
that
enviror~rnenta.
harm during
the
construction
period
to Lake
Springfield will be minimai~and that the
lake~spublic
water supply is not adversely affected.
Furthermore, the Agency
has concluded
that. denial would
impose an arbitrary or unreasonable
hardship
to
the
City.
Although
the
Board notes that the circumstances involved in
constructing
the bypass are
riot
an
emergency or unexpected nature,
it will
grant
this
provis:Lonai
variance
pursuant to Section 35(b)
of
the
Environmental
Protection
Act.
ORDER
The
City
of Springfield
is
granted
a
provisional
variance
from
the
suspended
solids
limitation
contained
in
35
Illinois
Administrative Act
304.124,
for a period of five days during the
construction
of its bypass,
subject to the following conditions:
1,
The City shall
notify
the Illinois Environmental
Protection
Agency
two
days
prior
to
diverting
flows
to
Lake
Springfield,
and notify the
Agency when the diversion has
ceased,

2.
The
period
of variance is to commence on the date
the City begins to divert its flows to Lake Springfield.
3.
The City’s discharge shall not exceed the total
suspended solids concentration of 225.0 mg/i during the
period of the variance.
4.
The City shall sample and analyze the diverted
flow for the parameters as required
in the NPDES permit and
report the results to the Agency within fourteen days after
the expiration of the variance.
5.
The City shall make reasonable efforts to reduce
wastewater flows during the period of this variance.
6.
Within
ten
days of the date of this Order,
Petitioner shall execute and forward to the Environmental
Protection Agency,
2200 Churchill Road, Springfield, Illinois
62706, a Certificate of Acceptance and Agreement to be bound
to all terms and conditions of this variance.
The form of
the certificate shall be as follows:
