OPINION AND ORDER OF THE BOARD
(by 3. D. Dumelle):
On August
5,
1982 the Board granted a provisional vari-
ance
to the Village of Franklin Grove from the biochemical
oxygen demand and suspended solids limitations of Rule 404(c)
and the fecal coliform standard of Rule 405 of Chapter 3:
Water Pollution
(now Section 304.120(c) and 304.121 of 35
Ill. Admin. Code,
Subtitle C).
On September 15, 1982 the Illinois Environmental Protec-
tion Agency (Agency)
filed a recommendation that provisional
variance be extended until October 15,
1982.
Based upon that
recommendation,
and as mandated by Section 36(c) of the Envir-
onmental Protection Act, the Board will grant that extension.
The Board notes, however, that the Agency has apparently calcu-
lated the termination date of the provisional variance granted
in PCB 82—95 on the basis of the date the Order was entered in
that case (August
5,
1982) rather than the date on which the
high rate sandfilters were taken out of service as was ordered
in that case.
ORDER
The provisional variance granted by Order of August
5,
1982
to the Village of Franklin Grove is hereby extended until
October 15, 1982.
IT IS SO ORDERED.
