On August 12,
1982 The Meyercord Company (Meyercord),
submitted a Verified
Application
for Nondisclosure for material
inadvertently submitted to the Board as part of a Variance
Petition and an Amended Petition filed April
22,
1982 and June
3,
1982,
respectively~ On August 12,
1982 Meyercord also submitted
a substitute Amended Petition for Variance, wherefrom the
confidential material had been deleted,
The Board
finds that the material Meyercord requests not to
be disclosed constitutes trade secret information and confidential
data pursuant to Section 7(a)(1)
and
(4) of the Act,
Accordingly,
the Clerk is ordered to destroy the material and any copies thereof
submitted April
22 and June 3, 1982 by Meyercord,
except for the
cover pages.
Since Exhibits A and B attached to the Application
for Nondisclosure also contain the confidential material,
these
and any copies thereof are ordered destroyed.
The Amended Petition
and Compliance Plan submitted August 12,
1982 by Meyercord will be
substituted in
their place.
In addition, Table A of the Agency~sRecommendation filed
July 12, 1982 contains certain information Meyercord has requested
to be confidentiaL
It is therefore ordered that the confidential
material be expunged from Table A.
Pursuant to Section
7 of the Act and this Order,
the Illinois
Environmental Protection Agency is ordered to destroy any copies
in its possession of the material listed above, except for the
substitution material.
IT IS SO ORDERED.
