    Proposed Rule. Dismissal Order.
    ORDER OF THE BOARD (by G.T. Girard):
    Pursuant to Section 22.40(a) of the Environmental Protection Act (Act) (415 ILCS
    5/22.40(a) (1996)), the Board would normally propose amendments to Illinois regulations that
    are “identical in substance,” as defined at Section 7.2 of the Act, with the United States
    Environmental Protection Agency’s (USEPA) amendments to the municipal solid waste landfill
    (MSWLF) rules adopted pursuant to Sections 4004 and 4010 of Subtitle D of the federal
    Resource Conservation and Recovery Act of 1976, as amended (RCRA Subtitle D). The
    Board reserved this docket for USEPA amendments during the period from July 1, 1998,
    through December 31, 1998.
    During the covered update period, the USEPA did not amend its 40 C.F.R. § 258
    RCRA Subtitle D MSWFL regulations in any way that would require Board action. Only the
    following action occurred during the update period:
    In a final rule published on October 23, 1998, (63 Fed. Reg. 57025) USEPA
    adopted requirements for state Subtitle D permit programs. USEPA will determine the
    adequacy of the state permit program. States must have authority to impose certain
    requirements for MSWFL units and for nonmunicipal, nonhazardous waste disposal
    units that receive conditionally exempt, small quantity generator waste.
    No further Board action is necessary based on this federal amendment.
    For the foregoing reason, no action is necessary at this time, and the Board hereby
    dismisses this proceeding.
