ORDER OF THE BOARD

On September 19,
1983 the Bank filed an amended petition for
variance,
in response to the Board’s Order of August 18,
1983
citing numerous deficiencies in the initial petition of August
5,
1983.
Although hearing on this matter was requested,
the
petition
remains deficient in a number of respects.
Although the County
of DuPage
(as treatment plant owner) and the Village of Darien
(presumably as owner of the sewer system) were served with a copy
of the petition, the Bank did not denominate them either as party
petitioners or respondents.
Paragraph
8 contains no figures con-
cerning costs of compliance alternatives, and paragraph
9 contains
no
figures to support its economic hardship claim, or details
which would support its asserted reliance on the “advice given by
appropriate authorities” that sewer capacity existed at the time
of the property’s purchase.
The Board cannot allow this matter to proceed to hearing,
given these deficiencies, as the petition does not contain
sufficient information to enable the Agency to make an informed
Recommendation prior to hearing
as
it is required to do.
An
amended petition should be filed within 30
days of the date of
this Order, or this petition will be subject to dismissal.
