On December 16,
1982 the Board entered an order in this
matter construing a letter from the Village of Seneca as a
petition for variance,
On January 13, 1983 the Board received
a second letter
(dated January 7,
1983) indicating that Seneca
does not wish to pursue a variance.
The Board construes that
letter as a motion to dismiss.
That motion is granted and proceedings
in this matter are
hereby dismissed.
The Board notes that in dismissing this
action,
it has made no determination as
to the necessity for
variance.
