    This matter comes before the Board upon an August

    motion to dismiss filed by Caterpillar, by which Caterpillar
    seeks
    to ratify and adopt
    a modified permit which the Agency
    had purported to issue
    to it.
    That motion is hereby granted.
    Proceedings in this matter are dismissed and the permit pur-
    portedly issued on June
    21,
    1983 shall he effective as of the date
    of this Order.
