    On January 19,
    1983
    Olin
    Corporation
    (Olin)
    filed
    a
    motion for reconsideration of the Board’s Order of December
    16,
    1982, granting a variance to allow wastewater discharges from
    Olin’s explosive waste incinerator and retort near Marion
    pending construction of a wastewater treatment plant.
    The
    motion indicates that Olin has finalized its construction
    plans, and that it will build
    a closed-loop system.
    Olin
    requests that the interim date for completion be put out to
    September 1,
    1983 from May 15, 1983 as previously ordered.
    On January 31, 1983 the Environmental Protection Agency
    (Agency)
    filed
    a response indicating no objection to this
    modification.
    Olin’s motion will be granted.
    On January
    31,
    1983 the Agency also requested that the
    Board modify paragraph
    5 of the December 16 Order to provide
    for analysis of composite samples by Olin rather than the
    Agency.
    The motion cites
    the cost of such analyses by the
    Agency, but does not explain why the Agency recommended this
    in the first place:
    “Petitioner shall submit for analysis
    composite influent and effluent samples of both the retort
    and incinerator operations once per week while in operation.”
    (paragraph 9(c)
    of the Amended Recommendation of September 24,
    1982)
    The Agency alleges that Olin has agreed to this modifi-
    cation which willalso be granted.
    The Order of December 16, 1982 is withdrawn and the
    following Order is substituted:
    ORDER
    Petitioner, Olin Corporation,
    is granted a variance from
    35 Iii. Adm. Code 304.124,
    304.125 and 304.126, subject to the
    following conditions:
    1.
    This variance will apply to discharges from Peti-
    tioner’s incinerator and retort scrubber to the strip
    mine pit on Olin’s facility located near Marion.

    2.
    This variance will expire September 1,
    1984.
    3.
    On or before September 1,
    1983, Petitioner shall
    complete construction of
    a wastewater treatment plant.
    4.
    On or before September 15, 1983,
    Petitioner shall
    submit a report on effluent quality from the plant,
    together with any plans to further upgrade the
    performance.
    5.
    Once per week,
    during the term of this variance,
    Petitioner shall take a composite sample of the
    scrubber effluent representative of one day’s
    operation of the retort or incinerator.
    Petitioner
    shall analyze such composites
    for each parameter
    listed on page
    2 of the Board’s Opinion of December
    16,
    1982.
    Once each month, Petitioner shall submit
    the results of the analyses, together with the times
    the retort and/or incinerator were operated during
    the sampling period, to the address
    in paragraph
    7.
    6.
    The Agency shall issue an interim NPDES permit authorizing
    this discharge pursuant to the conditions of this
    variance pending construction.
    7.
    Reports and analyses shall be submitted to the
    following address:

    8.
    Within forty—five days of the date of
    this Order,
    Petitioner shall execute and forward
    to the Illinois
    Environmental Protection
    Agency,
    Variance Section,
    2200 Churchill Road, Springfield,
    Ii.
    62706,
    a Certifi-
    cate of Acceptance and Agreement to he hound to all
    terms and conditions of this variance.
    This forty-
    five day period shall be held in abeyance for any
    period this ~natteris being appealed.
