On August
5,
1983 the Quaker Oats Company filed
a petition
for variance from Section 12(a) of the Illinois Environmental
Protection Act and 35
Ill. Adm.
Code 304.102(a)
and 304,141 to
allow wastewater discharges from its paperboard manufacturing
plant
in Pekin, through an “industrial ditch” and a “short chan-
nel” to the Illinois River
in excess of its permit limitations.
That petition is deficient in that hearing is neither
requested nor waived as required by Section 104.124 of the
procedural rules.
Further, the assessment of the environmental
impact
is limited to the impact upon the Illinois River and
additional
information should be provided regarding the character
of the “industrial ditch”
and the ‘~shortchannel” and the
environmental impact upon
them.
Unless an amended petition
is filed within 45 days of the
date of this Order curing the above-noted defects, this petition
will be subject to dismissal.
